How Long Do I Have To Claim For A Permanent Scar?

When claiming compensation for permanent scarring, you’ll need to take action within the correct limitation period. As outlined in the Limitation Act 1980, generally, you have three years from the date you were injured to start your claim.

However, if a child was scarred, the three-year time limit is frozen until their 18th birthday. From this date, they will have until their 21st birthday to begin a claim.

In instances where the claimant lacks the mental capacity to make their own claim, the 3-year limit is halted altogether. If they were to regain this mental capacity, the three-year time limit to begin a claim will be counted from the date of recovery.

In both instances where the time limit is frozen, a court-appointed litigation friend could make a claim on the injured party’s behalf. This should be someone who will act in the claimant’s best interest, such as a solicitor or parent, for example.
